1. CHANGES TO THIS NOTICE

We may modify this Privacy Notice from time to time. The date of change will be shown next to “Last Updated” at the top of this page and shall be considered the effective date. We encourage you to read this Privacy Notice periodically to ensure you have up-to-date knowledge of our privacy practices. Whenever material changes to this Privacy Notice are made, if we have your email address, we will provide you with notice before the modifications are effective by sending a message to the email on file. Otherwise, this Privacy Notice will be revised by updating a new version dated as of the date it takes effect. By continuing to access or use the Site and Services after changes to this Privacy Notice become effective, you agree to be bound by the revised Privacy Notice. If any changes are unacceptable to you, you may stop using the Site and Services.

This Privacy Notice sets out how Azra processes your personal information (or personal data or similar under other data legislation around the world – referred to only as “personal information” in this Privacy Notice) in connection with the provision of the Site and Services.

In particular, this Privacy Notice explains our approach to any personal information that we might collect from you (i) when you use the Site or Services (ii) during any other interactions with us, or (iii) which we might otherwise process when providing the Site or Services.

In addition, this Privacy Notice is intended to meet the requirements of the Regulation (EU) 2016/79 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (known as “GDPR”), as well as the “UK GDPR” (as defined in the UK Data Protection Act 2018). When we say GDPR, we mean both the EU and UK versions. Please refer to the Section 7 for details of how your personal data will be processed in accordance with US regulations (including the California Consumer Privacy Act (“CCPA”), as amended by California Privacy Rights Act (“CPRA”)) where appropriate.

 

3. INFORMATION WE COLLECT

The categories of information we collect depend on how you interact with us, our Sites and Services, and the requirements of applicable law. We collect information that you provide to us on our Sites and Services, information we obtain automatically when you use our Sites and Services, and information from other sources such as third-party services and organizations, as described below.

A. Information You Provide to Us Directly

We may collect the following information that you provide to us:

  1. User Information. If you sign up for an account or to join our Sites or Services we may collect personal information such as your email address and first and last name. In addition, we may also collect additional personal information you provide us, including via surveys.
  2. Your Communications with Us. We may collect personal information, such as your name and email address, when you complete the “Contact Us” form on our Sites, register for our mailing list, at one of our events, or otherwise communicate with us.
  3. Interactive Features. You understand that some of our Sites and Services are interactive and that we and others who use our Sites and Services may have access to personal information that you submit or make available through our interactive features (e.g., the games themselves, forums, blogs, and social media pages). Any personal information you post or provide on these features will be considered “public”, unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein.   4. Sweepstakes or Contests. We may collect personal information you provide for any sweepstakes or contests that we offer. Please be aware that in some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.
  5. Business Development and Strategic Partnerships. We may collect personal information from individuals and third parties to assess and pursue potential business opportunities.
  6. Job Applications. We may post job openings and opportunities on our Sites. If you reply to one of these postings by submitting your application, CV and/or cover letter to us, we will collect and use your personal information to assess your qualifications.

B. Information Collect Automatically

We may collect information automatically when you use our Sites and Services:

  1. Automatic Data Collection. We may collect certain information automatically when you use our Sites and Services, such as your browsing and gameplay information related to the Site and Services, information about your online interaction(s) with the Sites or Services or our advertising; details about the games and platforms you use and other information related to installed applications, your device type, software and hardware details, language settings, browser type and version, operating system, and information about how users use and interact with the Sites and Services (e.g., content viewed, pages visited, clicks, scrolls)
  2. Cookies, Pixel Tags/Web Beacons, and Other Technologies. We, as well as third parties that provide content, advertising, or other functionality on our Sites and Services, may use cookies, pixel tags, local storage, and other technologies to automatically collect data through your use of our Sites or Services.

C. Cookies

  1. What are Cookies: Cookies are small text files that are used to store small pieces of information. They are stored on your device when the website is loaded on your browser and uniquely identify your browser. These cookies help us provide a better user experience, understand how the website performs and to analyze what works and where it needs improvement. In addition to the cookies we use on this website, we also use tracking technologies in some emails and push notifications which enable us to understand whether you have opened the email and how you have interacted with it. If you have enabled images, cookies will be set on your device and will also be set if you click on any link within the email.
  2. How we use Cookies: As most of the online services, our Site uses cookies for several purposes. We use first-party cookies for understanding how the Site performs, how you interact with our Site and all in all providing you with a better and improved user experience and help speed up your future interactions with our Site.

We use your personal information to provide you with the Sites and Services, such as: (a) managing your personal information and accounts, as applicable; (b) providing access to certain areas, functionalities, and features of our Sites and Services; (c) answering requests for customer or technical support; and (d) communicating with you about your account, activities on our Sites and Services, and policy changes.

B. Administrative Purposes

We use your personal information for various administrative purposes listed below where we have a legal basis to do so, such as: (a) product research and development (including marketing research); (b) detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity; (c) measuring interest and engagement in our Sites and Services; (e) improving, upgrading or enhancing our Sites and Services; (f) developing new products and services; (g) ensuring internal quality control and safety; (h) authenticating and verifying individual identities; (i) debugging to identify and repair errors with our Sites and Services; (j) auditing relating to interactions, transactions and other compliance activities; (k) enforcing our agreements and policies; (l) to create aggregated analytics information, such as information about the device from which you access our Sites and Services; and (m) processing applications if you apply for a job we post on our Sites or Services.

  2. To promote safety, integrity and security. We use the information we collect to verify activity, combat harmful conduct, detect and prevent bad experiences, maintain the integrity of our Services, and promote safety and security.
  3. Complying with our legal obligations. We may process personal information as needed to comply with our legal obligations, including if we have a good faith belief that the law requires us to do so or when we have a good-faith belief it is necessary as described in Section 5 below.

 

5. WHAT IS OUR LEGAL BASIS FOR PROCESSING YOUR INFORMATION

If you are based in a location that requires us to establish legal grounds, we process your information on the following grounds: (a) to establish and perform our contract with you (such as the terms applicable to our Sites and Services, or to take steps at your request, such as to complete transactions with you and to allow you to play our games online) (b) perform analytics to better understand our users (c) conduct direct marketing (when we do not need your consent); (d) otherwise supporting our business, operations, and services; (e) enforce and prevent violations of our terms or policies (f) to protect your vital interests or those of another person (for example, another player); (g) consistent with your consent, which you may revoke at any time; (h) as necessary to comply with our legal obligations; (i) as necessary in the public interest; and (k) as necessary for our (or others’) legitimate interests, unless those interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data.

6. WHEN WE SHARE YOUR INFORMATION

We share your information to third parties for the following business purposes: to provide our Sites and Services, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below.

A. To Provide our Sites and Services
We may share your personal information with our third-party service providers who use that information to help us provide our Sites and Services. This includes service providers that provide us with IT support, hosting, payment processing, customer service, marketing and related services. By using our Sites and Services, you acknowledge that your personal information may be transferred to such third-party service providers. We may share your personal information with business partners to provide you with a product or service you have requested. We may also share your personal information to business partners with whom we jointly offer products or services. We may use third-party Application Program Interfaces (“APIs”) and software development kits (“SDKs”) as part of the functionality of our Sites and Services and your access or accounts may require the sharing of your personal information to third parties. .

We may access, preserve, and disclose information associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

C. In the Event of Merger, Sale, or Other Asset Transfers
If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and contract.

 

7. MANAGING YOUR CHOICES AND RIGHTS

We provide several options for you to manage: (a) your information as described in this Privacy Notice, (b) Service account(s), (c) communications you receive from us, and (d) how we use your information. These include through the settings in your Service account; email unsubscribe and deletion tools; and opting out of interest-based ads (note that you will continue to receive transaction-related emails regarding products or Services you have requested). ‍ Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

For the purposes of data rights, Azra does not “sell” personal information. Depending on your location, you may have certain rights over your information, including the right to: (a) request access to or a copy of your information, (b) request deletion of your information, (c) request correction or modification of your information, (d) be informed about the information we collect and/or process about you, the sources of information, and the third parties with whom information was shared and for what purposes, (e) withdraw consent, if processing is based on consent, (f) opt-out of the sharing of your information (including targeted advertising), (g) opt-in/out of financial incentives and (h) limit the use and disclosure of your sensitive personal information. You can make a data rights request in relation to your information by using the details provided in the Contact Us section below. We will respond to data requests within a month. We may take steps to verify your identity before we can respond to your request. To the extent these rights apply to you, they may be limited in some situations – for example when we are under a legal requirement or have a compelling interest for processing your personal information, or when the personal information is protected by trade secret. If you have unresolved concerns, where applicable, you may also have the right to complain to a privacy authority.

8. SECURITY OF YOUR INFORMATION

We follow generally accepted industry standards and maintain appropriate safeguards to help protect the security, integrity, and privacy of the information we collect about you. These security measures are designed to protect against the accidental or unlawful destruction, loss, misuse, alteration, and unauthorized disclosure of, or access to, the information under our control. However, while we have taken these efforts, you acknowledge and understand that no system can be 100% secure and we cannot guarantee our security measures. By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Sites and Services.‍

 

9. INTERNATIONAL DATA TRANSFERS

As we are a United States based company and our vendors and partners may process, transfer, and store information about you in connection with the Sites and Services in the United States and other countries that may not have privacy laws equivalent to the country where you reside. We take steps to apply appropriate safeguards when we transfer that information in accordance with this international data transfer requirements. If you reside in the UK, EU, EEA or Switzerland, we rely on Standard Contractual Clauses and/or other approved legal mechanisms to transfer personal information from the UK, EU, EEA or Switzerland to countries located outside of these locations. Please be aware that when your information is in another country, it may be accessed by the courts, law enforcement, and national security authorities pursuant to the laws of that country.

 

10. RETENTION OF PERSONAL INFORMATION

We store the data we collect as described in this Privacy Notice for as long as you use our Sites or Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Sites or Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

 

11. CHILDREN’S INFORMATION

The Sites and Services are not directed to or targeted to children under 13 (or other age as required by local law), and we do not knowingly collect personal information from children. If you are a parent or guardian and wish to review information collected from your child, or have that information modified or deleted, you may contact us as described in Contact Us section below. If we become aware that a child has provided us with personal information in violation of applicable law, we will delete any personal information we have collected, unless we have a legal obligation to keep it, and terminate the child’s account and/or revert them to the underage experience, as applicable.

The Sites and Services may contain links to other websites, applications or services and other websites, applications or services may reference or link to our Sites and Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website, application and service with which they interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites, applications or services. Providing information to third-party websites, applications or services is at your own risk.
